Teacher Professor

Can a teacher search through your phone once they confiscate it?

Today, my teacher said that once they confiscate your phone, they have the right to search through your texts ect. True or false?

Public Comments

  1. false-invasion of privacy
  2. No one including a teacher an touch anything of yours so NO!!!!!!!!!
  3. yes they can. your parents signed a paper saying the school is in charge of you during school hours. they can search your back pack, phone anything.
  4. no they don't have the right just because you would have to have other reasons like claims of harassment from that phone requiring evidence and stuff
  5. Theoretically yes. The supreme court has said that students have a lower expectation of privacy when in school. This was to give them the right to go through lockers. Electronic media are still an open case and if you find a good lawyer you might be able to take it to the supreme court, but the court has not ruled in favor of anything but students physical privacy in most of their decisions (you can't be strip searched in other words--except by a doctor/nurse, and then only with good, articulable reason)
  6. It's happening more and more often. Especially every time some creep emails nude pics of his girlfriend to other guys. Bottom line: whether it's right or wrong, they're probably going to do it and worry about the consequences later. So if you have texts on there that don't want for your teachers to see, email them to yourself and delete them from the phone. Keep your phone clean.
  7. Not even best technology can do this, so how can a teacher can?
